Appeal planned against BI declassing
Law firm Gordon Legal says it will appeal against a Federal Court decision that means participants in planned class actions will instead have to pursue their cases individually.
The class actions filed by the firm involved the National Opal Collection versus the underwriting members of Syndicate 2003 at Lloyd’s; and Strand Fitness and others versus QBE. They focused on covid-related business interruption.
The Federal Court held a case management hearing on December 5 after adjourning the matter in September for the “making of declassing orders”.
Any appeal is due to be lodged by Thursday this week.
“We are instructed to prepare that appeal and we will be filing it within the 14-day time frame,” Gordon Legal partner commercial law James Naughton told insuranceNEWS.com.au.
