AFCA appeals
Craig Kelly asks if AFCA determinations can be appealed.
"Matters in insurance are not ordinarily appealable," Mr Locke says. "There could be a judicial review if either party believes we have acted unlawfully, but ordinarily no."
However Mr Locke says consumers don't have to accept the adjudication. "You could still take further action. You are not prevented from going to court."
Mr Kelly asks whether insurers can dispute a determination.
"Say you make a decision that the insurance company doesn't like, can they say 'shove it up your jumper?'," he asks.
The short answer is no.
Mr Locke says an insurer is obliged to act on the determination, as they are signed up to the AFCA scheme.
"If they don't we would take it up with ASIC," he says. "We don't find with insurance companies that there is any failure to pay the amounts awarded."
