Whitlam case closed
The High Court has refused to grant the Australian Securities and Investments Commission (ASIC) special leave to appeal against a judgement of the NSW Court of Appeal related to former NRMA President Nick Whitlam.
ASIC had alleged that during his time as President, Mr Whitlam tried to obtain pay rises for NRMA directors by not signing proxy votes against a pay rise by thousands of members. Last July the NSW Court of Appeal upheld an appeal by Mr Whitlam and overturned orders made against him.
Acting Chairman Jeffrey Lucy says he has noted the decision. “The High Court’s refusal to grant ASIC’s application means that ASIC’s proceedings against Mr Whitlam are now concluded.”
