WA opens asbestos compensation inquiry

The WA Law Reform Commission is to review compensation rules for sufferers of asbestos-related diseases.

Possible reforms include changing the “once and for all” rule on personal injury judgements, so people who later develop different or more serious conditions can receive extra damages.

“The proposal to amend the ‘once and for all’ rule raises a number of complex issues that the commission has been asked to consider,” Attorney-General Michael Mischin said.

The commission may also allow damages to reflect the commercial value of personal or domestic work for others that incapacitated people can no longer provide.

Mr Mischin says examples could include tasks performed for an aged parent.

The commission will report to the Attorney-General with recommendations by June 30 next year.
