Judge forces ASIC to disclose
The Australian Securities and Investments Commission (ASIC) has been ordered by a Federal Court judge to tell former Zurich Asia Pacific CFO Warwick Churche about information it wants to share with another regulator.
Mr Churche had applied to prevent ASIC giving transcripts of his formal examinations last year to the Australian Prudential Regulation Authority (APRA).
Mr Churche wrote to ASIC on May 2 demanding an explanation for the decision to send the transcripts but it said it was not bound to reveal why it was sending this information to Mr Churche.
Last week in the Federal Court Justice Peter Graham ruled that ASIC’s decision did not fall within the exclusions that would have allowed it to keep the decision secret.
He said APRA’s request was “somewhat indiscriminate” and ordered ASIC to provide the information to Mr Churche.
