Stamp duty refund rush tipped
Stamp duty refund claims worth more than $50 million are expected to roll in to the NSW Government, now that the NSW Office of State Revenue is believed to have decided to accept a judgement against it.
There has been no official confirmation from the NSW Government, but a spokesman for Qantas, which stands to save $5.1 million, told insuranceNEWS.com.au the airline understands the Government will not take the matter further.
Last month the NSW Court of Appeal upheld a decision in the case of Qantas Airways v Chief Commissioner of State Revenue that found stamp duty was not payable under the NSW Duties Act on premiums paid to insurers not authorised by the Australian Prudential Regulation Authority before June 20 2006.
These include unauthorised foreign insurers.
Marsh Australia has announced it will liaise with relevant offices of state revenue about applications it has submitted on behalf of clients, estimating the industry-wide refund in NSW alone could exceed $50 million.
