Pasha Bulker negligence won’t affect claim

Insurance claims for the grounded ore carrier Pasha Bulker are unlikely to be affected by last week’s report that criticised the skipper’s actions.

The 225-metre coal carrier spent 25 days on a sandbar at Newcastle’s Nobbys Beach in June last year after it ran aground in wild storms.

An Australian Transport Safety Bureau report released on Friday found the master’s “inadequate understanding of heavy weather ballast” was largely responsible for the accident.

The NSW Government is still negotiating with the ship’s insurers over $2 million of associated costs.

Associated Marine National Manager of Hull Insurance Andrew Black says ships are typically covered by a hull policy and a protection and indemnity (P&I) policy.

It’s understood that in the case of the Pasha Bulker, salvage costs are covered by Lloyd’s, while UK insurer Britannia is the P&I carrier.

Mr Black says the safety bureau report is unlikely to invalidate the claims. “Negligence of the master doesn’t invalidate an insurance policy for the hull,” he told insuranceNEWS.com.au. “Of the maritime accidents that take place a large proportion do entail some form of human error.”
