NZ court throws out claims company’s case
The New Zealand High Court has struck out proceedings brought by claims services company WorldClaim against a former director.
In 2017 WorldClaim secured a ruling freezing the bank accounts of former Christchurch branch manager Guy Sayers, amid allegations concerning handling of claims and client funds following the Canterbury earthquakes.
However, WorldClaim did not continue with the action, and the court has now struck out the proceedings and discharged the freezing order.
“I am satisfied that, for whatever reason, the plaintiff has simply failed to prosecute its claim in this proceeding and it is just and equitable in all the circumstances prevailing here that these proceedings should be struck out,” Justice David Gendall said.
WorldClaim was ordered to pay costs.
