IAG customers win WA bushfire lawsuits

IAG customers are among 189 residents who have been awarded compensation for damage suffered during the January 2014 Parkerville bushfire in the Perth Hills.

WA Supreme Court judge Rene Le Miere ruled in the plaintiffs’ favour last week, four years after the first of four class actions was filed in 2015.

IAG was involved in one of the lawsuits, filing a class action in 2016 on behalf of its customers.

“Our focus has been on helping our customers and the community in the recovery action following the Parkerville bushfires,” an IAG spokesman told insuranceNEWS.com.au.

“We are pleased with the findings from the Parkerville judgement, which support the recovery for our customers’ overall losses, including their uninsured losses, and the recovery of our insurance losses.”

First-named plaintiffs Gary and Sandra Elwood, who started the first lawsuit in 2015, were awarded more than $774,000 for losing their home.

The payout to all plaintiffs could run into the millions when compensation is finalised.

Fifty-seven homes were destroyed and another six damaged by the fire, sparked by a fallen power pole owned and located on land belonging to Noreen Campbell.

Justice Le Miere ruled Ms Campbell and Thiess, the subcontractor hired to inspect the power pole, were liable for 30% and 70% of damages respectively.

He dismissed claims against Western Power, the utility company that contracted Thiess to undertake the inspection.
