Asbestos curbs proposed
Allianz Australia appears to have convinced the NSW Government to curb some claims being heard by the state’s Dust Diseases Tribunal. The tribunal, which hears asbestos-related disease cases and decides compensation for sufferers, will reportedly have its scope limited by new legislation after “heavy lobbying” by Allianz.
The Australian Financial Review says claims to the tribunal from workers living overseas or interstate will be barred to prevent “forum shopping” by lawyers.
Allianz has reportedly also proposed limiting the tribunal’s scope and imposing caps on damages. It’s doubtful, however, that the Government would adopt the entire Allianz approach.
