Perth financial firm pleads guilty to dishonest conduct

Perth-based Fong Financial Planners has pleaded guilty to three charges of dishonest conduct in relation to client insurance applications in the Perth Magistrates Court.

The WA District Court in Perth will fix a date for sentencing when the firm appears for mention on May 19. Director David Fong has had ASIC’s case against him discontinued.

In 2014 Fong Financial Planners, while serving as an authorised representative of AMP, acted dishonestly by recording information it knew to be false on forms submitted as part of client insurance applications to AMP, the Australian Securities and Investments Commission (ASIC) said.

ASIC says the firm “intentionally” failed to disclose all relevant information relating to the personal circumstances of the clients, including details of their health and medical history.

“Had this information been disclosed by Fong Financial Planners, further medical assessments and questionnaires may have been requested by AMP and exclusions may have applied to some of the insurance policies,” ASIC said.

The regulator says the incomplete disclosure of the information meant the duty of disclosure owed by the clients to the insurer had not been met and they risked not being covered by AMP under the relevant policies.
