For Australian insurers, April 5, 2021 heralds a new regulatory landscape where, for the first time, the industry's Insurance Contracts Act 1984 (ICA) will be subject to unfair contracts terms provisions known as ‘UCT Laws’.

Register for this webinar and hear an overview of the new regime from John Anning, Head of Regulation Policy at Insurance Council of Australia and Cain Jackson, Head of Financial Lines at Wotton + Kearney.

Mr Anning will provide an industry perspective on this long running issue and how members are going in terms of being prepared for commencement of the new obligations. Mr Jackson will outline the legislation and how insurers can understand and respond to the new regime.

At the end of this webinar, attendees will be able to:

  • Discuss the application of Unfair Contract Terms protections to general insurance and why it is a textbook example of how not to make good public policy
  • Describe how insurers can understand and respond to the new regime
  • Recognise that the approach adopted in light of the Financial Services Royal Commission recommendation is flawed but Unfair Contract Terms protections will still benefit consumers
  • Identify that flaws in the Financial Services Royal Commission recommendation may present serious challenges to insurers in the future.
